چکیده

International arbitration procedures have become more and more costly and time consuming both for the arbitrators and the parties. Therefore, some specifi c procedural options have developed “fi nal offer arbitration” (FOA) and “sealed offer arbitration”which, alongside with their numerous advantages, actually lead to some new problems. The article discusses those advantages and disadvantages of the two novelties in arbitration, trying to perceive them both from the common law and civil law point of view.

A Multi-Mode Resource-Constrained Optimization of Time-Cost Trade-off Problems in Project Scheduling Using a Genetic Algorithm

In this paper, we present a genetic algorithm (GA) for optimization of a multi-mode resource constrained time cost trade off (MRCTCT) problem. The proposed GA, each activity has several operational modes and each mode identifies a possible executive time and cost of the activity. Beyond earlier studies on time-cost trade-off problem, in MRCTCT problem, resource requirements of each execution mo...

Arbitration using the closest offer principle of arbitrator behavior

In this paper we introduce a model of arbitration decision making which generalizes several previous models of both conventional arbitration and final offer arbitration. We derive the equilibrium offers that risk neutral disputants would propose, and show how these offers would vary under different arbitration procedures. In particular, we show that optimal offers made under conventional arbitr...

Degree of Optimality as a Measure of Distance of Power System Operation from Optimal Operation

This paper presents an algorithm based on inter-solutions of having scheduled electricity generation resources and the fuzzy logic as a sublimation tool of outcomes obtained from the schedule inter-solutions. The goal of the algorithm is to bridge the conflicts between minimal cost and other aspects of generation. In the past, the optimal scheduling of electricity generation resources has been ...

Amended Final-Offer Arbitration is Improved Arbitration: Evidence from the Laboratory*

Arbitration is frequently utilized to settle disputes. Much research has focused on the properties of final-offer arbitration (FOA) relative to conventional arbitration. Both mechanisms should encourage settlement in standard environments, but previous empirical work finds that impasses remain common. A modification of FOA, amended final-offer arbitration (AFOA), has been proposed as an alterna...

Retailer’s optimal credit period and cycle time in a supply chain for deteriorating items with up-stream and down-stream trade credits

In practice, the supplier often offers the retailers a trade credit period M and the retailer in turn provides a trade credit period N to her/his customer to stimulate sales and reduce inventory. From the retailer’s perspective, granting trade credit not only increases sales and revenue but also increases opportunity cost (i.e., the capital opportunity loss during credit period) and defau...
